DUI Laws

Many are confused when it comes to the complex array of DUI laws.  For the basic underlying offense of driving after consuming intoxicating substances there are many nuances of potential charges.  These vary by locality and sometimes one term can mean one thing in a given city but entail a different meaning when used in another city.

DUI stands for driving under the influence.  In some jurisdictions this term is used interchangeably with the acronym DWI which stands for driving while intoxicated.  In other localities they are two different offenses entailing varying consequences.  This complexity is just one of many sources of confusion that start the minute you are pulled over for DUI

In some places DUI is a lesser offense than DWI.  DUI, or driving under the influence, simply indicates that a motor vehicle was being operated with the driver still being effected by any intoxicating substance.  In these places, any amount of intoxication can trigger a DUI charge.  To get to the more serious DWI charge it is necessary to exceed the applicable BAC (blood alcohol content).

As indicated, the source of intoxication does not necessarily have to be alcohol.  Other legal and illegal intoxicants can qualify as the root cause of the offense.  However, the preponderance of all DUI cases relate to the use of alcohol.  DUI is a lesser offense in some jurisdictions to DWI, however it can still entail serious consequences.

Just because you have been charged with DUI as opposed to DWI doesn't mean that finding a DUI lawyer is any less important.  DUI convictions can result in substantial fines, and in some circumstances a DUI conviction can result in actual jail time.  This is especially so if you have a serious prior vehicle related conviction.

In terms of your future, what is a DUI?  A DUI conviction is a serious event, however many just like you in your same situation have been able to overcome the mishap and effectively put it behind them.  Retaining a good lawyer and then subsequently avoiding future trouble allows you to go on with your life with lessons learned.  It is not the end of the world.  Some research and effective counsel will enable you to get your life back on track.
